OVERVIEW
The trademark registration system (unless specified otherwise, the contents for "trademark" are applicable to all the other marks 
like service mark, collective mark, certification mark and business emblem) of the Republic of Korea ("Korea," below) is based 
on the first-to-file system, which means that a trademark registration belongs to the first person who files an application for the 
trademark and gets the registration. 

However, if a mark is not registered but is well known in Korea, the mark may be protected under the Korean Trademark Law
("KTA") and the Unfair Competition Prevention Act ("UCPA").
NICE CLASSIFICATION SYSTEM
Korea adopted NICE Classification System, the International Classification System of Goods and Services, as of March 1, 1998.
MULTIPLE CLASS APPLICATION
As of January 1, 1999, Korea adopted the Multiple Class Application System in which multiple classes of goods and/or services
can be filed in single application. A multiple class application may reduce the prosecution cost for filing and registering a mark
for multiple classes of goods and/or services. However, the multiple class application also has a disadvantage that if a rejection
is issued with respect to one class of goods/services, it may delay the registration of the mark itself until the rejection is 
overcome. In such case, a divisional application may expedite the registration of the mark for other (unobjected) class(es) of 
goods/services.
SUBJECT MATTER OF TRADEMARK
1. DEFINITION
  " Trademark" is a word, name, symbol, figure, device, three-dimensional shape, any combination thereof, or any 
  combination of color therewith which is used in trade with goods to indicate the source of the goods and to distinguish them
  from the goods of others. 

  "Service Mark" is the same as a trademark except that it identifies and distinguishes the source of a service rather than a
  product.

  "Collective mark" a trademark or service mark used, or intended to be used, in commerce, by the members of a cooperative,
  an association, or other collective group or organization, including a mark which indicates membership in a union, an
  association, or other organization.

  "Certification mark“ is any word, name, symbol, device, or any combination, used, or intended to be used, in commerce with 
  the owner's permission by someone other than its owner, to certify regional or other geographic origin, material, mode of 
  manufacture, quality, accuracy, or other characteristics of someone's goods or services, or that the work or labor on the goods
  or services was performed by members of a union or other organization. A certification mark is processed and treated
  substantially the same as a trademark. 

  "business emblem“ is a mark used by a person engaged in a nonprofit business like the YMCA or Boy Scouts to indicate that
  person's business (e.g. Republic of Korea National Red Cross, Junior Chamber, Rotary Club, Korea Consumer Agency, etc.)
 
2. UNREGISTRABLE MARKS
  Registration may not be granted for a mark falling under any of the following: 
  a) marks identical or similar to the Korean national flag, national emblem, colors, medals, decorations, or badges

  b) mark identical or similar to the national flags of allied nations of the Paris Convention for the Protection of Industrial 
     Property (hereinafter referred to as the "Paris Convention"), member nations of the World Trade Organization, or 
     contracting parties to the Trademark Law Treaty (hereinafter referred to as "allied nations, etc.")

  c) mark identical or similar to the titles, abbreviated names or marks of the Red Cross, the International Olympic Committee,
     or renowned international organizations: Provided, That the foregoing shall not apply where the Red Cross, the International
     Olympic Committee, or renowned international organizations have applied for trademark registration of its title, abbreviated 
     name or mark

  d) mark identical or similar to armorial bearings, flags, medals, decorations or badges of allied nations, etc. designated by the
     Commissioner of the Korean Intellectual Property Office after being notified from the World Intellectual Property
     Organization under Article 6-3 of the Paris Convention or to titles, abbreviated names, armorial bearings, flags, medals,
     decorations or badges of inter-governmental international organizations in which allied nations, etc. have joined: Provided, 
     That the foregoing shall not apply where an inter-governmental international organization in which an allied nation or allied 
     nations, 
     etc. have joined applies for trademark registration of its title, abbreviated name (limited to an inter-governmental 
     international organization in which allied nations, etc. have joined) or mark

  e) mark identical or similar to seals or signs used for indicating supervision or certification by allied nations, etc. designated by
     the Commissioner of the Korean Intellectual Property Office after being notified from the World Intellectual Property
     Organization under Article 6-3 of the Paris Convention or their public organizations and used for the goods identical or 
     similar to those for which such seals or signs are used

  f) marks indicating a false connection with any nation, race, ethnic group, public organization, religion, or famous deceased
     person

  g) mark identical or similar to famous marks indicating nonprofit business of the State, a public organization or its agencies 
     or public corporations, or indicating nonprofit public services: Provided, That the foregoing shall not apply where the State, 
     public organization or its agencies or public corporations, or the body of nonprofit public services applies for trademark
     registration of such marks

  h) marks contrary to public order or morality

  i) marks identical or similar to a medal, certificate of merit or decoration awarded at an exhibition held by or with the 
    authorization of the Korean Government or at an exhibition held by or with the authorization of the government of a
    foreign country; however, this provision shall not apply where the person who has been awarded the medal, certificate of 
    merit or decoration has used it as a part of his trademark on the same goods for which such medal, certificate of merit, or 
    decoration was awarded at the exhibition 

  j) marks containing the name, title or trade name, portrait, signature, seal, pseudonym, professional name or pen name of 
    well-known persons, or an abbreviation thereof; however, this provision shall not apply where the person concerned has 
    consented

  k) marks identical or similar to another person's registered mark whose application was filed prior to the trademark
     application concerned and whose designated goods are identical or similar to those of marks concerned

  l) marks identical or similar to another person's registered trademark, where one year has not passed since the date of lapse 
    (nullification) of the person's trademark right (in case the trademark registration was cancelled by a trial decision, the date 
    that the trial decision became final and conclusive) and whose designated goods are identical or similar to those of the other
    person's goods 

  m) marks identical or similar to another person's trademark which is well-known among consumers as indicating goods of the 
      other person, and whose designated goods are identical or similar to the other person's goods

  n) marks liable to cause confusion as to goods or businesses of another person which is recognized to be famous among 
     consumers 

  o) marks deceptive or liable to mislead consumers as to the quality of the goods

  p) marks which are identical or similar to a trademark which is well-known as indicating the goods of a particular person by
     consumers in or outside Korea, and which are used for unjustifiable purposes of obtaining unjust profits or inflicting harm
     on the particular person 

  q) marks consisting solely of three-dimensional shapes which are essential to secure the function of the designated goods or
      their packaging

  r) marks consisting of geographical indications or including such indications with regard to the origin of wines and spirits in 
     a member of the World Trade Organization, and which are used in connection with wines, spirits, or other similar goods 
     thereto

  s) mark identical or similar to a name of varieties registered pursuant to Article 109 of the Act on the Protection of New 
     Varieties of Plants, and which is to be used for goods identical or similar to such name of varieties

  t) mark identical or similar to another person’s geographical indication registered pursuant to Article 32 of the Agricultural and 
     Marine Products Quality Control Act, and which is to be used for goods identical or recognized as identical to the goods 
     using such geographical indications

  u) mark identical or similar to another person’s geographical indication protected pursuant to free trade agreements that have 
     been concluded between the Republic of Korea and foreign countries in a bilateral or multilateral manner and come into 
     effect, or any trademark which consists of or contains such geographical indications and is to be used for goods identical or
     recognized as identical to the goods using such geographical indications
