SUBJECT MATTER OF DESIGN

Design means an article(including part of an article and font)'s shape, pattern, color, or combination thereof which produces an
 aesthetic visual impression. 
Design consists of three-dimensional features such as shape or surface of an article, or two-dimensional features such as 
pattern, line, or color of an article.

REGISTRATION REQUIREMENTS

1. Industrial applicability
    Industrial applicability requires that a design should be mass-produced through an industrial production process

2. Novelty
   Novelty requires that a design should be neither publicly known through a printed publication or catalogue, nor marketed 
   or exhibited in public, nor laid in a state that many unspecified persons can see the design. 

   Novelty also requires that a design should be neither publicly known or worked in this or a foreign country prior to the filing 
   of the design application, nor described in a publication distributed in this or a foreign country prior to the filing date. 
 
   Moreover, novelty cannot be recognized for similar designs to those that lost novelty under the above two requirements. 

   In case a design lost novelty under any of the above, the design can be deemed to be novel if the inventor files the
   design application within six (6) months from the date when the design fell under any of the above. To take advantage of 
   this novelty fiction, the inventor should also submit a written statement at the time of filing the design application, and a 
   document proving relevant facts should be submitted within 30 days from the filing date of the application. 

3. Originality
   A design is not deemed to be original if it can be invented by a person having ordinary skill in the art to which the design 
   pertains, in terms of shape, pattern, color, or combination thereof widely known in Korea.

UNIQUE FEATURES OF DESIGN ACT

1. Similar Design
   A design registrant or applicant is entitled to obtain a registration for similar design to the registered design or pending 
   application. Only, this is not appliable to a design similar to the registered design or pending design application based on
   similarity. 

2. Multi-Design Application 
   For an examination-exempt design application, twenty or less designs in the same class can be filed in a single application 
   ("multi-design application"). A multi-design application can be filed to cover a design and its similar designs together. 

3. Examination-Exempt Application 
   For an examination-exempt design application, the registration may be granted if the filing formalities are completed and the 
   design does not violate the public order and good practice.

4. Secret Design
   A design applicant may request that the design be kept secret for a designated period of time, but not exceeding three 
   years from the date of registration. However, the Korean Intellectual Property Office (KIPO) may allow a person other than the
   owner (applicant) of the design to have access to the secret design upon request under certain conditions.
