APPLICATION

NECESSARY DOCUMENTS
1. Conventional Patent Application
   (1) The following information should be submitted under Art. 42 (1):
      (i) Name and address of the applicant
      (ii) Date of filing of the application
      (iii) Title of the invention
      (iv) Name, nationality and address of the inventor
   (2) The application should be accompanied by specification, drawings (if any), and abstract under Art. 42 (2) and (3).
   (3) The Power of Attorney must be submitted when filing an application or within one month after the issue date of the 
      notice to request its submission.
   (4) Copy of deposit of microorganism (if required)
   (5) Electronic file of sequence lists (if required)

2. National Phase Entry of PCT Application
   (1) Copy of PCT application
   (2) Power of Attorney: Must be submitted when filing the application or within one month after the issue date of the notice 
      to request its submission.
   (3) Amendments made under PCT Article 19 (if required)
   (4) Amendments made under PCT Article 34 with a copy of form PCT/IPEA/409 (if required) 
   (5) Document attesting the deposit of microorganism
   (6) Electronic file of sequence lists (if required)
PRIORITY DOCUMENTS
1. Conventional Patent Application
   A certified copy of priority document(s) and a Korean translation(s) thereof must be filed within sixteen (16) months from the 
   earliest priority date. 
2. PCT Application
   It is not necessary to file priority document(s) with the Korean Intellectual Property Office (KIPO).
AMENDMENT OF PENDING PATENT APPLICATIONS
1. For an application filed before July 1, 2001
    The amendment may be submitted
    - at the time of filing the request for examination
    - within fifteen (15) months after the filing date of the application or after the priority date
    - within thirty (30) days after the demanding date of a trial against the final rejection
    - within the designated time for response to the notice of rejection. 

2. For an application filed on or after July 1, 2001 
   The amendment may be made
   - at any time before receiving the certified copy of a decision to grant patent or a notice of rejection, or 
   - within time limits designated for submission of a response if a notice of rejection was issued.

3. For a PCT Application
   In case an amendment is made under PCT Article 19 or 34, a Korean translation of the amendment must be filed at the time
   of entering the Korean national phase.
DIVISIONAL PATENT APPLICATION
If a patent application includes two or more inventions, the application should be divided into two or more applications 
voluntarily or under the examiner’s rejection for lack of the unity of invention. If a divisional application is filed that satisfies the
requirements, it is deemed to have been filed at the time of filing the original application. 



1. Requirement for Filng a Divisional Application
  (1) Formal Requirements
    The original application must be pending in the Patent Office.
    The divisional application must be filed while amendments to the original application can be filed. 
    The request for filing a divisional application must be made by the applicant of the original application. 

  (2) Substantive Requirements
    The original application must include two or more inventions in the specification or drawings.
    The divisional application may not contain matters which are not within the scope of the original application.


2. Request for Examination for a Divisional Application

   A request for examination must be filed within five (5) years from the filing date of the original application. However, if a 
   divisional application is filed, the request for examination may be filed within thirty (30) days after the date of filing the
   divisional application, even after the five-year time limit has passed.
